A Sale-Contingency Removal Demand During an OKC Downsizing Move

If you receive a demand to remove a home-sale contingency while downsizing in the Oklahoma City metro, first identify the supplement you signed and the deadline triggered by delivery. Then determine whether you can truthfully provide the required sale or financing evidence. Do not sign away a termination condition simply because you still want the next home.

This is a later decision than choosing whether to sell first or buy first. A household may already have selected a smaller home, scheduled movers and begun sorting furniture when a backup offer changes the calendar. The useful question becomes: what can we actually prove, deliver and afford by the notice deadline?

Identify the supplement you actually signed

The Oklahoma Real Estate Commission publishes a sale-of-buyer-property supplement for a home not under contract. It addresses continued marketing and a seller demand after an acceptable backup offer. Your transaction might instead use another supplement, a builder agreement or negotiated language. Pull the executed purchase contract, all supplements and every signed amendment together before choosing a response.

Ask your agent to identify the paragraph authorizing the demand and the provision defining delivery. If the documents conflict, have your Oklahoma real estate attorney resolve that conflict. A familiar form name is not evidence that the form was actually incorporated into your purchase.

Record delivery and the response deadline

The 2026 seller demand form calls for at least 24 hours after delivery and addresses extension when the deadline falls on a Saturday, Sunday or legal holiday. It also states the consequence of failing to remove the condition. These are form-specific terms, not a universal deadline for every contingent purchase.

Save the demand, envelope or email, attachments and delivery information. Make one calendar entry showing the received time, the contractual due time and who verified the calculation. Arrange an earlier internal decision time so a lender’s missing letter does not become a last-minute signature problem. Do not assume a casual telephone conversation extends the written deadline.

Test the three evidence paths

OREC’s Buyer Removal of Condition Notice identifies three routes: a qualifying contract for the existing home, financial-institution evidence supporting purchase without a sale condition, or a completed sale. Each route calls for its appropriate supporting documentation. Read the allowed conditions on the actual form before treating an offer on your old home as sufficient.

A practical worksheet has three columns: route selected, exact attachment required and person delivering it. For a sale-contract route, ask your agent to review dates and remaining contingencies. For a financing route, ask the lender to address the sale dependency expressly. For a completed sale, obtain the evidence requested in your file instead of sending a photograph of a check.

Recheck the two-home cash plan

Documentary eligibility and household comfort are separate checks. Imagine an OKC owner buying a smaller home while the larger home’s sale is still uncertain. A lender may be willing to proceed, but the owner must still decide whether overlapping payments, utilities, insurance and moving expenses fit available cash.

List money already committed, money needed at the new closing and the reserve remaining afterward. Run a second version with the old sale delayed. Include any storage or temporary lodging quote you would actually use. This is a planning exercise, not a prediction that the delay will occur. If the purchase works only when hoped-for proceeds arrive on an exact day, tell the lender and attorney before signing the removal notice.

Deliver a complete response and preserve receipts

Have the response and attachments reviewed together. Check names, property identifiers, signatures, dates and the selected evidence route. A complete response should be understandable without a chain of missing forwarded messages. Use the delivery method required by your agreement and retain proof.

Keep a simple outgoing index: document name, version, recipient and sent time. Confirm receipt through the appropriate transaction professionals. Avoid sending full bank statements or sensitive account details to an unnecessarily broad recipient list; ask what evidence is needed and how to transmit it securely. Save the final packet with both closing files.

If the condition cannot be removed

Tell your agent and attorney before the deadline. They can evaluate the signed agreement, any proposed amendment and the effect on termination and earnest money. Do not assume a refund or an extension merely because a new home-sale offer seems likely tomorrow.
