Temporary leave from work can change how a lender evaluates income for an Oklahoma divorce buyout, but it is not an automatic denial. For a mortgage under Fannie Mae’s rules, the expected return date relative to the first payment matters. Ask the lender to review the actual leave, income and asset documents before you promise a refinance or buyout completion date.
Confirm the loan program and type of leave
Fannie Mae’s temporary-leave guidance generally addresses employee-initiated, short-duration leave, including parental leave and short-term medical disability. Employer-initiated furloughs and layoffs are excluded from this particular category. Start by asking whether the proposed loan follows this guidance and whether your situation fits it. Do not label a job separation as temporary leave because you hope to return. Equally, do not assume a brief approved absence makes regular earnings unusable. Describe the employment facts accurately and let the lender identify the applicable treatment. In a divorce buyout, counsel separately addresses the settlement’s deadlines and obligations; a mortgage guideline does not amend the decree or release either spouse from existing debt.
Build a return-to-work evidence file
The lender needs documentation of regular income and the amount and duration of leave income, your written intent to return, and employer or authorized administrator documentation of the expected return date. Fannie Mae identifies those as distinct parts of the review. Fannie Mae: B3-3.3-09 Temporary Leave Income
Ask the loan officer for a precise document list before requesting duplicate letters from payroll, human resources and a leave administrator. Put each document’s date and issuing source on a simple checklist. Send sensitive records through the lender’s secure channel. Your real-estate timeline can show that the income review remains open without circulating medical details or private divorce papers among everyone working on the transaction.

Compare the return date with the first payment
Under the cited Fannie Mae guidance, returning by the first loan payment date can allow regular employment income to be considered. If the return is later, the lender generally uses the lesser of leave income and regular income, with a prescribed option to supplement from qualifying liquid reserves. These are underwriting branches, not a promise of approval. Fannie Mae: B3-3.3-09 Temporary Leave Income
Ask the lender to show the expected first payment date beside the return date. A closing date and a first payment date are not interchangeable. For illustration, two borrowers closing on the same day could need different income analyses if their documented returns occur at different times. Avoid adjusting a work-return representation merely to fit the housing calendar; use the real employment arrangement.
Do not count the same cash twice
Fannie Mae describes liquid reserves as assets available after closing and subtracts funds needed to close when evaluating reserves. Its temporary-leave calculation also excludes transaction funds and required reserves from the liquid amount available to supplement income. For a buyout, make separate lines for the payment to the former spouse, closing costs, debt payoff, escrows, required reserves and a household moving cushion. Ask which funds the lender can actually recognize, and at which stage. An account balance shown before the buyout is paid is not necessarily the amount remaining afterward. A disputed or inaccessible asset also needs review before it appears as available money in the plan.
Keep the lender’s calculation with the loan file rather than trying to reconstruct approval from an online example. The relevant amounts depend on the verified assets, employment dates and transaction. A comfortable household budget and a qualifying-income calculation serve different purposes; you need to understand both.

Ask for a clear explanation of any concern
Federal consumer guidance prohibits mortgage discrimination based on familial status. That protection is separate from a lender’s legitimate review of documented repayment ability. Ask for the actual income or documentation issue if an explanation sounds like a blanket rule about parenthood or family circumstances. CFPB: Can a lender ask about children or dependents?
Preserve correspondence and ask the lender’s designated contact to explain the applicable program rule. If you believe discrimination occurred, use the consumer agency’s complaint resources or seek qualified advice. Do not conceal material income changes or assume that a legal protection guarantees the amount, terms or timing of a particular mortgage.
Keep the buyout calendar conditional until verified
Have the lender identify remaining conditions and the next review date. Ask counsel how the settlement handles a financing delay and what alternatives require agreement or a court decision. Keep the new loan, deed work, existing-loan payoff and any release of liability as separate closing tasks.
