For an Oklahoma residential tenancy covered by Title 41, request the deposit in writing and document termination and possession delivery. Section 115 generally allows 45 days after all three conditions and requires written demand within six months of termination. Keep the refund separate from your next-home budget and preserve a clear move-out record.
Read the current rule rather than an old summary
Current section 115 uses 45 days, rather than the 30 days found in older summaries. The required conditions are tenancy termination, possession delivery and written demand; missing the six-month demand deadline terminates the tenant's deposit interest. Ask a qualified adviser about disputed dates or coverage. Do not let a search snippet choose the deadline in your calendar. Read the current provision beside your lease and event records. Oklahoma Statutes, Title 41.
Make the request explicit and keep a copy
A practical demand can identify the tenant, rented address, lease or account information, termination and possession dates, forwarding address and an explicit request for the security-deposit return and any required itemization. Avoid including a bank password, unrelated financial record or unnecessary identification number. Use the lease's applicable notice instructions and obtain advice if they are unclear. Keep the exact demand you sent, the method used and the date; a later recollection that you mentioned the deposit is weaker documentation.
Confirm where the demand should go
Section 116 addresses disclosure of management and an owner or authorized notice recipient. Review the lease and later written management changes before choosing where to send the demand. If the property changed managers near move-out, ask which address should receive it and preserve that answer. A maintenance text number or old payment account may not answer your notice question. Oklahoma Statutes, Title 41.

Document possession delivery as well as condition
Record the key-return or other agreed possession-delivery arrangement. Keep the move-out checklist, relevant condition photographs and any written acknowledgment together. Condition evidence and possession evidence serve different purposes: one concerns the state of the home; the other helps establish when the landlord regained possession. Ask for clarification if belongings remain, a garage opener has not been returned or the landlord gives a different completion date. Do not describe a disputed handover as settled in your own calendar.
A deposit is not automatically last month's rent
Section 115 permits specified deductions, requires written itemization and restricts last-month-rent substitution unless the rental agreement provides otherwise. Keep rent obligations separate from the later refund. Review the actual lease with a qualified adviser instead of assuming that a deposit equal to one monthly payment authorizes withholding rent. Document which charges you recognize and which require explanation. Oklahoma Statutes, Title 41.
Plan your next-home budget without an assumed refund date
An OKC-area tenant buying a home may have closing costs, movers and overlapping housing expenses due before a deposit dispute is resolved. Build the immediate budget using funds you can actually access rather than a presumed full refund. In a hypothetical move, a written request, possession delivery and tenancy termination occurring on different dates need to be reviewed together before selecting a statutory deadline. There is no universal rule that 45 days begins when the moving truck leaves.

Review an itemized response against your records
When a response arrives, compare the listed deductions with the lease, payment history, move-in and move-out evidence and any agreed repairs. Identify the exact disputed line rather than simply declaring the whole statement wrong. Preserve the response and envelope or transmission record. Ask a qualified Oklahoma legal adviser about disputed deductions, notice compliance and available remedies. This article does not predict a court outcome, promise damages or determine whether a charge in your lease is enforceable.
Assign one person to the correspondence
If several adults share the move, choose one person to maintain the deposit file and a backup who can find it. Record which household member sent the demand and which address was used. Ask that incoming mail and digital responses be saved in the same place. This practical arrangement helps prevent two different forwarding addresses or an unanswered letter from being lost among purchase documents. It does not determine who legally owns a claim or replace the names and obligations in the lease.
Keep the rest of the move organized too
The rental-deposit demand is a financial and documentation task. Obtaining mailbox access at the next home is a different move-in decision covered in our related guide. A simple move checklist can assign different owners to deposit correspondence, key delivery, utilities, address changes and the new-home closing. Checking off one item should not conceal that another remains unresolved.
Leave a useful record after the move
Keep the demand, delivery evidence, lease, condition records, itemization and refund information in one folder until the matter is resolved.
