Do not assume an Oklahoma probate home is immediately available for sale because title passed to heirs or a personal representative was appointed. A surviving spouse, and in some circumstances minor children, may have a separate probate homestead right to possess and occupy the property. The estate lawyer should identify that right, any enforceable liens, and the court order or consent needed before the home is marketed as vacant or freely deliverable.

Separate title from the right to occupy
Oklahoma’s probate homestead rule can protect a surviving spouse’s right to continue occupying the family homestead even though title passes through inheritance or devise. The Oklahoma Supreme Court describes that occupancy right as distinct from title.
That distinction changes the listing question. A deed, will or heirship statement may identify ownership interests but still not prove the estate can promise vacant possession on the buyer’s timetable.
Identify who may hold the protection
Current Oklahoma authority limits the statutory probate homestead allowance to a surviving spouse and, in the circumstances described by statute, minor children. An adult heir living in the property does not automatically receive the same protection merely because of possession or family relationship.
Ask counsel to document marriage, minor-child status, occupancy, prior court orders and any waiver. Do not pressure an occupant to sign a listing or move agreement before their legal position is reviewed.

Review liens and carrying costs separately
Probate homestead protection does not erase every enforceable mortgage, tax or other permitted lien. Gather the note and mortgage, property taxes, insurance, HOA records, recorded liens and the estate’s cash plan.
Price the home only after the estate understands which costs continue during occupancy and which obligations may affect title or sale proceeds. Keep estimates labeled until the responsible professional confirms them.
Confirm the personal representative’s authority
Letters of administration show an appointment, but the exact sale path can depend on the will, court orders, notices, consents and Oklahoma probate procedure. The listing package should identify who can sign and what approval remains outstanding.
Use a clear condition in the service and contract timeline for any required court action. Do not advertise court approval as complete before the signed order exists.

Plan showings around privacy and possession
If an authorized listing proceeds while a protected occupant remains, agree in writing on access, notice, security, personal property and photography boundaries. Avoid publishing medication, family papers, portraits or facts about the probate dispute.
A respectful access plan is both practical and accurate. It prevents marketing from implying immediate possession when the estate cannot yet deliver it.
Close only from the final authority file
Before accepting closing instructions, match the deed, probate orders, occupancy resolution, lien evidence and settlement statement. If a homestead right was waived or terminated, preserve the actual signed or entered record.
This is heightened legal guidance, not a substitute for an Oklahoma probate lawyer. The purpose is to surface the sale-authority decision early so the family does not build a moving or purchase plan on an unsupported assumption.
